Template Terms of Use

All purchasers or downloaders must also abide by the following restrictions. By purchasing or downloading any flyer templates licensed by Small-Business-Graphic-Design.com, you automatically agree to the following terms and conditions.

USAGE

You may use the Template(s) offered on Small-Business-Graphic-Design.com for personal use.

You have a non-exclusive, non-sublicensable, non-transferable, worldwide and perpetual right to edit the Template(s), by changing or inserting new text or otherwise personalizing the Template(s) for a particular project, to create derivative works, such as advertising and promotional materials, print publications, HTML email documents and websites, (“Derivative Works”) in any and all media for all purposes other than those uses prohibited under the Restrictions section of this Agreement.

You may have the Template(s) or your Derivative Works edited and reproduced by your subcontractors (service providers, such as graphic designers and printers), provided that such subcontractors agree to abide by the provisions of this Agreement. You may also provide your Derivative Works to your client as electronic files as long as the client does not create new derivative works from those files.

You may display your Derivative Works on your website, in emails and printed products provided, however, that the Derivative Works are completed projects and not simply substantially unedited reproductions of the Template(s).

RESTRICTIONS

Your rights to use Template(s) are limited in the following manner, in addition to any other restrictions provided in this Agreement or by law:

Except as described in the grant of license in Section 1 above, you may not post any Template(s), depiction or portion thereof online or on a private network or place any Template(s) or Derivative Work online in a downloadable format or as an editable web-to-print template, whether or not you represent the Template as the work of Small-Business-Graphic-Design.com or others, or offer any Template(s) or Derivative Work for sale or other such distribution without obtaining a special license or written permission to do so from Small-Business-Graphic-Design.com.

You may not falsely represent, expressly or impliedly, that you are the original creator of the Template(s).

Use of a Template in a manner not specifically authorized by this Agreement constitutes an infringement of our proprietary rights and those of our third party licensors and will subject you to infringement damages. Use of a Template in a manner that is contrary to a restriction stated in this Agreement is prohibited.

Template(s) are licensed with no rights protection on a non-exclusive basis. Small-Business-Graphic-Design.com gives no rights or warranties with regard to the use of names, trademarks, registered or copyrighted designs, elements or works of art depicted or contained in any image in any Template(s), and you must satisfy yourself that all of the necessary rights or consents, as may be required for your use of the Template(s), are obtained.

Pornographic, defamatory or otherwise unlawful use of Template is strictly prohibited, whether directly or in context or juxtaposition with specific subject matter. You are also required to comply with any applicable regulations and/or industry codes.

COPYRIGHT

Small-Business-Graphic-Design.com and its licensors own and will retain all copyrights in and to any Template(s), including any image contained in any Template(s). You may not copy, modify, sell or distribute all or any part of any Template(s) except as expressly authorized in this Agreement. The Templates are protected by United States copyright law and international treaty. Unauthorized reproduction, modification, sale or distribution is subject to civil and criminal penalties.

You cannot redistribute, resell, lease, license, sub-license or offer any Template(s) to any third party.


DISCLAIMER

All licensed Template(s) are provided “as is” without warranty of any kind, either expressed or implied. Small-Business-Graphic-Design.com is not liable for any damages arising out of any defects in our materials. You agree to hold Small-Business-Graphic-Design.com harmless for any result that may occur during the course of using, or inability to use these licensed Template(s). In no event shall we be liable for any damages including, but not limited to, direct, indirect, special, incidental or consequential damages or other losses arising out of the use of or inability to use any Template(s).


PAYMENT

PayPal is used for payments. You can read their Terms of use and Privacy Policy on their site.


REFUND POLICY

No refund will be offered for Template(s) once sold. Since they are digital files, all Template(s) are not refundable or exchangeable. However, files can be replaced if damaged or lost. Simply send us an email.


RESERVED RIGHTS

We reserve rights to change the prices of our symbols and/or symbol sets without prior notice and at our sole discretion. We reserve the rights to make changes to these ‘terms and conditions’ without any prior notice at our sole discretion. Any such changes will reflect on this page.
